This privacy policy (the “Privacy Policy” or “Policy”) of RHO Management (“Company,” “we,” “us,” or “our”) describes our privacy practices regarding personal information we collect, including from persons (“you” or “your”) who access our property’s RENTCafé Resident Portal website or our related mobile applications that may be available for download (collectively, the “Site”). PURPOSE. The purpose of this Privacy Policy is to inform you about the types of personal information we gather about you, including personal information gathered when you visit the Site, and personal information we may receive from third parties or affiliates in addition to that online information, how we may use that information, whether we disclose that information to anyone, and the choices you have regarding our use of, and your ability to correct, the information.  This Policy does not cover information that is exempted from privacy policy notification requirements, including information about employees, contractors, job applicants and information processed exclusively in the context of a business person acting in a business capacity.

THE SITE IS NOT INTENDED FOR CHILDREN AND COMPANY DOES NOT KNOWINGLY SOLICIT OR COLLECT PERSONAL INFORMATION ON THE SITE FROM CHILDREN UNDER THE AGE OF 13. Company may amend this Privacy Policy from time to time. We will post those changes on the website or update the Privacy Policy date below.  In certain cases, you will be notified via email or by a notice on our website. 

PERSONAL INFORMATION COLLECTED IN THE PAST 12 MONTHS

We collect, process and store various types of Personal Information.  For purposes of this Policy, “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.  It does not include de-identified or aggregate information, or public information lawfully available from governmental records.

Personal Information we collect may include:  your name, email addresses, postal addresses, postal codes, user Internet Protocol (IP) addresses, social security/insurance number, driver’s license number, prior addresses, monthly rent paid at prior residences, employers, job titles, income, telephone numbers, credit card information, bank account information and routing numbers, date of birth, gender, age, marital status, user name and password (if you choose to become a registered user of the Site or our products and services), emergency contact information, information about your pets, information about your vehicles including license plate numbers, and other information either desirable or necessary to provide quality services to our residents and visitors.  We may also collect information about you such as your use of the Site and communication preferences.

We do not and will not sell your Personal Information.

Additional Information about How We Collect and Share your Personal Information

With respect to each of the categories of data above, we may also collect and share Personal Information with third parties to comply with legal obligations; when we believe in good faith that an applicable law requires it; at the request of governmental authorities or other third parties conducting an investigation; to detect and protect against fraud, or any technical or security vulnerabilities; to respond to an emergency; or otherwise to protect the rights, property, safety, or security of our business, third parties, visitors to our websites and mobile apps, or the public.  We may also share Personal Information with any person to whom we transfer any of our rights or obligations under any agreement, or in connection with a sale, merger or consolidation of our business or other transfer of our assets, whether voluntarily or by operation of law, or who is otherwise deemed to be our successor or transferee.

PERSONAL INFORMATION WE WILL CONTINUE TO COLLECT

We will continue to collect the same categories of Personal Information listed above, for the same purposes. 

USE OF COOKIES AND OTHER TECHNOLOGIES. Like many other website operators, Company may use cookies to customize content specific to your interests and track your use of the Site. “Cookies” are text files that are placed on your computer and may be used to store your personal information. In addition to cookies, Company may use other now known or later developed technologies, to assist Company in observing the behavior of users visiting the Site. These technologies access individual user information but the information is used only to compile aggregated statistics about the Site’s usage.

Our service providers may use cookies and those cookies may be stored on your computer when you visit our website.

This Site uses Lead Attribution or Marketing Attribution to assess the conversions of different channels that generate leads.

This Site uses Google Analytics (and in the future may use other similar sites or services), a web analytics service provided by Google, Inc. (“Google”), to better assist Company in understanding how the Site is used. Google Analytics will place cookies on your computer that will generate information that we select about your use of the Site, including your computer’s IP address. EMAIL AND TEXT MANAGEMENT. You may receive emails and texts from Company for a variety of reasons. We respect your desire to manage email and text correspondence. If you have an account with Company on the Site, you can select your preferences through your account settings. You can also manage your receipt of certain types of communication by following the instructions included in the email we send you. Please note that, even if you unsubscribe from certain email correspondences, we may still need to email you with information relating to your unit, the management of the property, and other important transactional or administrative information. 

THIRD-PARTY WEBSITES. This Privacy Policy applies solely to information collected by Company. This Privacy Policy does not apply to other websites that are accessible through this Site, including but not limited to any third-party websites.

ACCESSING, REVIEWING AND CHANGING YOUR CONTACT INFORMATION. As an account holder, you can see, review and change most of your contact information associated with your Account Profile by logging into your account and editing your Account Profile.  For assistance, you may contact us using one of the methods listed below. With some exceptions, you have the right to see what Personal Information we hold about you. We can help you identify what records we might have about you. We may need to confirm your identity before providing you with this access, and if we cannot verify your identity with the degree of certainty required, we will not be able to respond to your request.  If we cannot give you access, we will tell you within 45 days of receipt of your request and provide you with a reason, as best we can, as to why we cannot give you access.

PERSONAL INFORMATION OF MINORS. Our Sites are not directed to minors under the age of 16 and we do not knowingly collect Personal Information from minors.  We may collect Personal Information of minors, provided by parents or guardians, in connection with the application and rental of a unit, or the provision of property management services.  We do not sell the Personal Information of minors.

CALIFORNIA RESIDENTS’ RIGHTS. The California Consumer Privacy Act (CCPA) may apply to California residents whose Personal Information is collected by landlords of a certain size or that meet other criteria. If the CCPA applies to us, California residents may request to know about Personal Information collected about them and request deletion of that Personal Information. These rights are subject to certain exceptions, including without limitation, for Personal Information subject to the Fair Credit Reporting Act and the Gramm-Leach-Bliley Act.  If we are subject to the CCPA, you can learn more about these rights and our processes for consumer requests by contacting us using one of the methods listed below. If you exercise any of the rights afforded to you by the CCPA, we will continue to treat you fairly.

Right to request disclosure of information we have collected about you

If the CCPA applies to us and to your information, you can submit a request to us for the following personal information we have collected: 

  • The categories of personal information we’ve collected about you.
  • The categories of sources from which we collected the personal information.
  • The business or commercial purposes for which we collected or sold the personal information.
  • The categories of third parties with which we shared the personal information.
  • The specific pieces of personal information we collected about you.

Right to request the deletion of personal information we have collected from you 

Upon request, we will delete the personal information we have collected about you that is covered by the CCPA, unless a relevant exception to the right to deletion applies.

WHAT PERSONAL INFORMATION DOES RHO COLLECT?

The Personal Information we collect is described in general terms below.

We collect Personal Information from our websites in order to provide you with details regarding services and products in which you have expressed interest or we believe will interest you, and to increase our understanding of how we can assist our clients, prospective clients, residents prospective residents, and employees. The type of Personal Information we collect depends upon what RHO can provide based upon the products and services that interest you.

Additionally, we collect Personal Information so we can administer certain services to residents and applicants. These services include, but not be limited to, those that are necessary and customarily required to complete any transaction, sale, delivery, or similar, in addition to other services that RHO may offer or provide from time-to-time (“Company Services”).

In the case of prospective RHO residents, we may request Personal Information including some or all of the following: name; address; age or date of birth; e-mail address; occupation and employment information; telephone number; educational background; Social Security number, government identification number, or other identification number; credit, debit, or other payment card information; and financial account information. Further, individuals interested in becoming residents are asked to include the following, additional Personal Information: the kind of service being requested, their desired apartment size, their desired apartment amenities and features, their desired location, their budget for rent, their household size and the ages of their household’s occupants, and the presence of pets in their homes.

If you become a resident of one of our communities, we may ask that you provide your credit card information to pay for rent and other services. Since we provide may of our services through contractual arrangements with third parties, it may be necessary that we release certain Personal Information to these vendors. The use of your Personal Information by these third-party contractors is governed by their privacy policies and terms of use.

RHO communities have separate sites. Likewise, these sites are utilized for to process rental applications and agreements. These sites are also used to assist residents with other tasks related to their residency (e.g., such as paying rent through online services). Those types of services are not handed through this website, and a different Privacy Policy may apply to their usage.

In the case of prospective RHO employees, we may request Personal Information including some or all of the following:: name; address; age or date of birth; e-mail address; work history; telephone number; educational background; Social Security number, government identification number, or other identification number. In addition, we may request credit checks, background checks, reference checks, and employment verification. When required, we will obtain the candidate’s consent before undertaking these checks. When a candidate accepts a position, the candidate may be asked to provide us with additional Personal Information. This additional Personal Information may include the option to self-identify with a race or ethnicity. We only collect this Personal Information for the purpose of meeting government reporting requirements; further, the provision of this information by candidates is voluntary.

Current residents in our communities may be asked to provide Personal Information including, but not limited to: name, address (including apartment number), e-mail address, and any additional information as may be required as it relates to fulfilling the task for which the Personal Information is necessary.

USAGE TRACKING: USE OF IP ADDRESSES

IP addresses are numbers that are automatically assigned to your computer whenever you are connected to the Internet. Web servers, the main computers that provide web pages, automatically identify your computer by its IP address. As permitted under applicable law, we collect IP addresses for system administration, gathering aggregated information, analyzing aggregated information, creating better online experiences for our users, and for auditing the use of our website. This process does not normally link IP addresses with Personal Information; however, your session will be logged, along with your IP address, but remain anonymous to us. We will seek to link IP addresses with Personal Information when we feel it is necessary to protect this site and other users from harm and to prevent criminal misconduct. USE OF “COOKIES”

RHO will not disclose Personal Information except as described in this Privacy Policy, unless we have your permission or under special circumstances (e.g., if we believe, in good faith, the law requires us to disclose this information). Additionally, RHO may disclose Personal Information for business operations as described below.

We do not share your Personal Information with third parties or commercialize it, unless:

  • Said information is shared or commercialized following after a specific request is received or permission is granted from a user;

  • Said information is shared with affiliated companies or potential investors in any form of business transaction (e.g., purchase or merger) pursuant to agreements that contain reasonable confidentiality arrangements;

  • Said information is shared with third-party vendors and service providers that work with us pursuant to agreements that contain reasonable confidentiality arrangements, so we can more effectively administer our management responsibilities and business objectives;

  • Said information is shared in compliance or accordance with any applicable law or court order; or in order to prevent suspected illegal acts, frauds, or situations involving potential threats to the safety of any person; or as otherwise required by law. This description includes responding to lawful requests by public authorities, and meeting national security or law enforcement requirements;

  • Said information is shared in order to assist RHO in defending against claims or in establishing or exercising any legal right that RHO may have;

  • Said information is shared in order to assist RHO in preventing violations of its Terms of Use and this Privacy Policy or to otherwise protect the rights, property, or safety of its employees, residents, users, and other individuals. This description includes exchanging information with third parties for fraud protection and credit risk reduction, in accordance with any applicable laws.

BUSINESS TRANSITIONS

If RHO undergoes a business transition (e.g., a merger, acquisition, sale, or similar), the Personal Information acquired from users will, in most circumstances, be part of the transferred assets. In an event such as this, the use of Personal Information will remain in accordance with the Privacy Policy that is in place at the time of the transfer. By utilizing our websites and providing us with your Personal Information, you are consenting to this transfer of information.

THIRD-PARTY SITE LINKS

When you use an RHO website, you may be directed to other third-party sites that are beyond our control; such websites may include those for residential communities. Likewise, links from RHO to other websites, may take you outside our service (e.g., clicking on a hyperlink within an advertisement may take you to a different, non-RHO website) It is possible that these other websites include those of advertisers, sponsors, or partners that use their logo with RHO’s in conjunction with a co-branding agreement. Additionally, these other sites may send their own cookies to users for the purposes of collecting data or soliciting information. RHO does not control these websites and therefore cannot be held responsible for their content. The presence of hyperlinks to other websites on RHO’s website does not imply any endorsement of the material on those websites; nor does it imply any association with the operators of those websites.

RHO’s policies do not extend to anything that is inherent to the operation of the Internet, which is beyond RHO’s control. Whenever someone gives out Personal Information online, that information may be collected and used by strangers. If users have any questions about security, they are free to contact us using the information in the “Contact Information” section.

SECURING INFORMATION

RHO seeks to safeguard its user’s Personal Information and takes reasonable technical and organizational measures to do so. While we aim to protect our customer’s Personal Information, as well as their privacy, RHO is unable to guarantee the security of any Personal Information you disclose online. As such, you disclose any Personal Information at your own risk.

We strive to limit access to users’ Personal Information to those individuals and organizations we believe reasonably need such information in order to perform their jobs appropriately or to provide our services. RHO takes reasonable precautions to protect the security of users’ Personal Information. Unfortunately, as with many computer systems, internet applications, and software programs: the unauthorized use, the failure of hardware or software, and similar unintended events, may harm to the confidentiality of our users’ Personal Information.

The security of all our users’ Personal Information is of the utmost importance and concern to us. Hence, when new technology becomes available, we periodically review and improve our security. These security measures may include the use of software that encrypts or distorts data submitted on our website regarding applications. EMAIL CONSENT AND OPT-OUT

By providing Personal Information through any of our registration forms through this website, you are affirmatively consenting that we may contact you via e-mail for the purpose of providing you with information and notices relating to: the property where you live; various similar services available to you at or through that property; and various other properties that may be available and of interest to you now or in the future. Providing this information also means that you are consenting to receiving e-mails from us regarding updates to this Privacy Policy.

If you choose to opt out of receiving future commercial e-mail messages from resulting from your use of this website, you may do so. Mass commercial e-mails that we send contain hyperlinks with instructions on how to remove yourself from our e-mail list. However, if you are a resident of an RHO community and you use this site in addition to your individual community’s site, you may need to opt-out of your community site separately. CHILDREN’S PRIVACY

Our website is not directed at, nor intended for the use by children. We do not knowingly collect Personal Information from minors under the age of sixteen (16) which requires parental notice and consent under the Children’s Online Privacy Protection Act (“COPPA”) without first receiving such parental consent. Likewise, we do not allow children under the age of sixteen (16) to become registered users of our websites. By using our website, you are acknowledging and representing that you are not under the age of sixteen (16). If you are a child under the age of sixteen (16), you are not permitted to use this website. If you are a child under the age of sixteen (16), you should not send any Personal Information about yourself to us through the site.

If we become aware that we have collected Personal Information from any child under the age of sixteen (16), we will dispose of that information, or otherwise treat it in accordance with COPPA and other applicable laws and regulations. If you are a parent or guardian and you believe that your child under the age of sixteen (16) may have provided personally identifiable information through our websites, please urgently contact us using the information in the “Contact Information” section.

INTERNATIONAL VISITORS

RHO Residential, LLC is located in the State of New Jersey within United States. Any Personal Information you provide to us, may be transferred to and processed on computers in the United States and in other countries. If you are providing Personal Information and are not a resident of the United States, your country’s laws governing data collection and use may differ from those of the United States. Particularly, the United States may not provide the same level or kind of protections as those in your own country. Do not provide Personal Information to us if the laws in your country restrict the information that can be transferred outside of your country, or if you do not want this information to be transferred outside of your country. By providing information to RHO, you are transferring your personal data to the United States, and you consent to the transfer to, retention of and processing of your data in the United States.

CORRECTING AND DEACTIVATING PERSONAL INFORMATION

Users may have the right under applicable privacy laws to request, freely and at reasonable intervals, that RHO inform them as to whether their Personal Information is being processed. Subject to certain exceptions under applicable privacy laws, you may also possess the right to request that RHO correct, supplement, delete, or block your Personal Information in the event that said information is factually inaccurate, irrelevant, or incomplete for the purposes of RHO’s processing activities, or if the Personal Information is being processed in some manner that infringes upon a legal provision. If you intend to exercise your rights, or if you have any questions or suggestions regarding the use, security, or collection, of Personal Information, you are free to contact us using the information in the “Contact Information” section.

When a request for user deletion is received, RHO will make all reasonable efforts to purge said data from its systems. Because of the nature of this service, it may not be possible to fully remove some information because of the presence of backups or archived copies. Following a deletion request, any Personal Information that was not deleted from our server because of an exception under the applicable privacy laws, will only be used in accordance with those applicable exceptions (e.g., for the purpose of performing a contract that the user has entered into with RHO).

DATA SECURITY

RHO takes reasonable steps to secure your Personal Information. However, no data transmission over the Internet is guaranteed to be completely secure. Similarly, the processing and storage of Personal Information on this website, or on other servers to which the information may be transferred, cannot be guaranteed to be completely secure. It is important to understand this information before submitting your Personal Information to us through the website.

NOTIFICATION OF CHANGES

If we should make any changes to our Privacy Policy, those changes will become effective upon posting.
